    Abstract: 政府採購制度採用以最低標方式辦理公共工程,造成廠商低價搶標,衍生偷工減料,被認為是品質不佳的主要原因。921地震之後,為維護整體營造業環境,營造業法實施,建立提升營造業環境的機制。營造業法規定允許結合政府採購法相關規定,進而提升投標廠商素質,但政府採購制度卻未將相關制度結合,導致公共工程還存在低價搶標的困境,無法有效提升工程品質。政治學界自90年代以來,新制度主義的觀點研究相關的制度行為,除修正傳統制度主義之外,融入行為學派的觀點,加上經濟學、社會學等觀點,使新制度主義成為一種研究制度行為的一種新的研究方法。新制度主義強調的不只是制度本身的框架規範或法律條文,對於行為者對於制度的遵守、修正及破壞導致制度變遷,都認為是制度發展的一部分,僅就條文或制度本身進行研究,並無法顯現出制度本身的缺失或演化及行為者對制度的影響。本文將從營造業制度與政府採購制度結合,從制度運作的觀點,說明現行公共工程採購品質不佳的問題,與營造業整體環境不佳有關,政府未能有效結合相關法規,導致此情形沒有改善。以新制度主義的觀點說明在現有機制之下,公共工程採購品質無法提升的原因。
    Government Procurement system adopting the lowest tender to handle public works causes getting bids at low-cost for companies and doing shoddy work and using inferior material, and it is considered to be the main reason for poor quality. After 921 earthquake, In order to safeguard the overall construction industry environment, the Construction Industry Act enhance the environment mechanisms of the construction industry. After the implementation of the Construction Industry Act, the law allows the combination of the relevant provisions of the Government Procurement Law, enhancing the quality of the tenderer. But the government procurement system has not been combined with related systems; leading to public works gotten bids at low-cost situation, it still can not effectively improve project quality.Since the 1990s, the new institutionalism research has returned to study the system and institution. The new institutionalism has not only fixed the view of the traditional institutionalism but also integrated views of economics and sociology. New institutionalism emphasizes on the system itself, the framework of norms, article and the actors to comply with the system. In addition, corrections and destructions which lead to institutional change are considered part of the system development. Only researching on the article and system itself can not show the flaws or evolution of the system itself and influence on actors to the system.This article combined with the construction industry system and the government procurement system, from system working viewpoint, we can see the current poor quality of public works procurement, it’s because the bad situation in construction industry, the Government fails to effectively combine with the relevant laws, resulting in this situation does not improve. From the new institutionalism viewpoint under the existing mechanism, it’s the reason why we can’t enhance the quality of public works procurement.
