| 摘要: | 新興科技的進步與突破，無論是工業、交通、醫療、營養、公共衛生等等，導致人類的生活都有了重大的影響和改變，使用藥品(drug)、手術、醫療設備以及各種的醫療方式來延續我們的生命，加上2000年世界跨國「人類基因體計畫」（Human Genome Project）的解碼，將使得人類各種疾病的治療達到了巔峰。而傳統的製藥產業(pharmaceutical industry)最終的產品-藥品，是一般民眾取得止痛或減輕病狀甚至痊癒，最直接也是最快速的方法，但是藥品的提案、研發、實驗、審核、上市直到自由流通(Free Movement)，是一條遙遠的馬拉松接力賽，如何能用同一種審核藥品的方式和管理的方法來處理各國彼此之間的藥品事務，乃至於快速流通於歐盟各國，加上歐盟設置了一個專業審核藥物的管理機構-歐洲醫藥品管理局(European Medicines Evaluation Agency, EMEA)來統一管理歐盟會員國繁雜的藥物事務，而各會員國也出現了不同的意見，在現有的審核程序下進行檢測；以藥用大麻(Medical cannabis)為例，歐盟會員國有些國家認為大麻是毒品的惡瘤之初，應該趁早管制以免釀成毒害國人，但也有些國家認為大麻如同菸草一般，不應該如此強硬制止，加上各方研究證實大麻確實有其獨特醫療性的功效，種種意見也造成了歐盟各國對於大麻的定義和規範有了不同的詮釋和管制，作者將以大麻這個範例，探討出歐盟會員國如何在現有的法律規範下，衍生出另一條新的流通途徑，藥用大麻的範例不僅深化歐盟的流通精神，也奠定藥品自由流通的新道路，藥用大麻是為佐證本文藥品自由流通重要的舉證。
Emerging science and technology progress and breakthroughs comprise the industrial, transport, health, nutrition and public health and so on. The lives of human beings have a major impact and change in the use of drugs, surgery, medical equipment and any medical means to continue our life. In 2000 , we was decoding the human genome, we will allow a variety of human diseases reached a peak. The traditional pharmaceutical industry's end-products is the drugs, it is the general public of made to reduce pain or even heal symptoms. This is the most direct and rapid way. But the drug proposal, R & D, test, review and the listing until the flow is the long distance marathon competition. Which way can do the same way drugs audit and management methods among the countries to deal with drug matters? As well as in the rapid flow of European Union countries? Therefore, the European Union set up a professional organization-the European Medicines Evaluation Agency to integrate with manage of the European Union Member States to complicated drugs, but there have been different voices. For example, the Medical cannabis was the some European Union countries believe that cannabis is the drug at the beginning of the malignant swelling , they should control as early as possible so as not to lead to poison in human, but that some countries also like Medical cannabis tobacco in general, should not be so tough to stop. Plus the various research confirm that Medical cannabis does have its unique therapeutic efficacy. All kinds of views The European Union resulted in the definition of Medical cannabis and norms have different interpretations and control. I will research cannabis this item, explored how the EU Member States under the existing legal norms are derived from the circulation of another new way. Example of Medical cannabis is not only deepening the flow of the spirit of the EU, but also to lay new roads free flow of drugs. In support of Medical cannabis will proof the Free Movement of drugs in European Internal Market. |
