摘要:	本論文以禁止與限制色情材料的相關法律和行政規則為對象，藉由解釋其中的限制，指出言論管制在解嚴以後的台灣社會並沒有完全地結束，反而從政治移轉至文化領域，特別是兒少與色情材料這兩個領域最常成為檢查制度的對象。　　　這項發現來自對檢查制度的歷史進行分析，並歸納出檢查制度和色情檢查以及分級制度的相似之處：第一，檢查制度事實上是對被權力建構的異議、偏差或邊緣份子的壓迫，這當中自然包含了對提倡政治自由、民主思想份子的壓迫，但這只是檢查制度對付的對象之一，並非可以說明檢查制度的完整歷史，而是和既有權力結構對立的所有人們與言論都極可能是檢查制度的對象；易言之，色情材料之所以成為檢查制度的對象，也跟它們被權力建構的偏差、邊緣、異常等特性有關；其次，我還發現藉口對特定人口的保護措施是實施檢查制度常見的理由，而訴諸兒少保護的分級制度就是這個藉口與理由之一。簡單來說，從生物條件定義一個人的能力與心智程度是最常見的手法，女人與兒少是這類手法常見的被壓迫者，其他手法還包括從宗教與資產等角度去預設人口的意義，但這跟一個人的能力與心智程度沒有關聯，而是後天加諸在他們身上的。　　　　除了上述因素外，色情材料的普及往往被用來解釋台灣社會新興性現象出現的原因，而導致了色情檢查與分級制度在公民以及相關實證研究的支持之下，不但成功地被民主化了，也順利地隱身於公共政策的範疇之中，這個事實反映了檢查制度並非是政治專制與威權時代的獨有產物，而是當人民獲得普遍的權力╱利以後，差別只是在於發生的政治場域不同罷了！　　This thesis will present a discussion on the related laws and regulations governing pornography. Through this discussion, I find that there are still some limitations on the rights to freedom of speech even if people in Taiwan have had a political democracy since termination of the Martial Law. These limitations, shown that censorship has moved from a political to cultural fields, are made, in particularly, on children and a specific category of pornography. 　　　There are two evidences which can support the correlations between censorships in political speech and pornography, and censorship and publication classification system. First, I find that there is a similarity between two types of censorships, lying in a clash existing between two sides because pornography, representing people's culture of the marginalized sexualities, is against social members having a normal perspective of sexuality. And a political censorship, like ones in pornography, is established and implemented on people, and what they say and write opposition to a political class in power. Second, I still find that the implementation of a censorship in the name of protectionism is not an exclusive phenomenon but a social or political classification in power get used to using some physical determinisms to judge a person's capabilities. So, a classification system based on age is just another system that attempts to control people and those are children.
