    Abstract:   隨著社會變遷、時空更迭與基於動物權的提昇、環境衛生的改善等因素,許多國家均已對寵物福利或動物屍體處理的方面著手立法或提出呼籲。本研究有鑒於台灣社會仍以﹝廢棄物清理法﹞處理動物屍體,而少數鄉村地區仍保有「死貓吊樹頭、死狗放水流」的風俗,不僅影響土地永續經營,更危害人類生存健康。本研究以動物權利、依附關係理論為基礎,透過次級資料分析與電話訪談飼主,以探討寵物地位之提升、飼主與寵物之間的關係變化,進而了解寵物殯葬之必要性,另依循制度變遷理論以建構較完善的寵物殯葬制度。此外,實地訪談寵物殯葬設施經營業者,以了解其經營之困境與現行法律之缺失,最後再輔以電訪方式訪談政府行政人員、殯葬禮儀師與殯葬法規講師等之見解,俾利參考以確立寵物殯葬立法體例及主管機關歸屬構想。    經研究結果發現,現今飼主多以「擬人化」方式對待所飼養的寵物,在將其視為「家人」之際,倘若以廢棄物處理著實不符合民眾普遍之需求。而坊間雖有寵物殯葬設施,但礙於現行法律規定,確有其申請經營上之困難。在制度設計考量上,立法體例及權責歸屬各有其不同之優缺點,本研究分析主張採取單獨立法的方式較好,而職掌業務則以劃歸民政單位的優點較多。
      With social changes, as well as space and time shift, base on improved animal rights and environment hygiene conditions in our society, many nations have implemented or appealed for legislative on pet animal welfare and dead body treatment. In this research, in view of dead animal bodies still processed by complying Waste Clean-up Law, there are also some rural customs with animal dead bodies hung on trees or flown in rivers. This situation does not only impede land eternal management but also menace peoples' health. This research is based on animal rights and attachment relation theories. Through secondary data analysis and telephone interview, the research is aimed to the elevation of pet status and the relation changes between pets and pet keeps. Furthermore, it is meant to understand the necessity for pet funerals. The well-planned pet funeral systems can be established by complying with system shift theories. In addition, the on-site interview is implemented to understand the difficulty in business management and currently legal defects. Finally, the research is further added with telephone interview to know about the opinions from governmental administration agents, funeral operators and instructors for funeral regulations with the reference to firmly establish legal systems for pet funerals and ideas from government authorization concerned.     As it is found from research results, currently, numerous pet keepers treat their own pets like a person in a personalized way. When pets are viewed as a family member of keepers, if the dead animal bodies of pets are processed by complying with Waste Clean-up Law, it will be naturally far beneath general demands from the public. Although there have been numerous funeral facilities available for pets, impeded by current laws, it really comes with the difficulty to apply for business running management. In consideration of system design, legalizing systems and responsibilities are featured with different advantages and disadvantages. In this research, it is recommended with a better way, namely the independent legalization. Governmental responsibilities legally due to civil affair units will be more favorable.
