    Abstract:   本文希望在變化如此快速的虛擬世界中,嘗試在世界各國對數位著作權所下的新範圍與定義中理出頭緒,歸納出數位時代網際網路所應有之規範,同時分析現今歐盟在數位環境下所為之著作權相關指令,並尋找其間之共通點或優缺點,希望本文能為未來台灣修法之參考。   本文首先介紹現行著作權規範概念,後述數位化著作之意義與法律環境,提出因應網際網路之著作權制度與規範,其次分析國際著作權條約之關係與各著作權條約之重要部份,而後進入數位時代歐洲聯盟之政策與著作權相關指令之分析,介紹數位網路時代著作權規範之修正,並以歐盟針對數位著作權指令修法為主,而台灣九十二年著作權法修正為輔,將兩者加以分析,以證明本文首先提出的因應網際網路之著作權規範,最後提出數位化著作權法修正後對台灣應有之啟示,並綜合上述討論提出結論。   本文結論認為在數位及網際網路世界之著作權制度調整,應顧及科技、個人私益、社會公益三者之融合與協調,考量數位科技之本質與其合理使用型態後,平衡著作人權益與社會文化發展之社會公益,始提出具體措施,使著作人能「適當」的取得合理報酬,著作之流通與利用更合法與自由,使數位科技與社會生活、法律制度相結合,才是著作權制度於數位時代的真正意義。
      The emergence of the Internet, along with the prevalent applications of digital imaging and desktop publishing, has raised an issue, old but still radical, which conventional writers, artists and photographers need to re-cope with: the reproduction of their works. The advancement in the essence of copying from hard copy into digitized materials is much more significant and immense than simply that in the technique of copying. And the copyright laws deserve attentive amendment accordingly. The thesis mainly aims to formulate some new ideas applicable to the legislation of copying in the cyber world. An attempt is made to reduce notions concerning the copyright regulations under the framework of International Copyright Treaties. Moreover, with the analysis of the E.U. legislation on copyright in digital environment, the thesis will scrutinize crucial defect and the merit of the E.U. copyright directives. It is hoped that the paper can also contribute some provocative and constructive thought for the further amendment of Taiwan copyright law. In terms of research approaches, at first, the paper makes a pilgrimage of the vested Copyright concept and discusses the copy problems of digitized work; its legal dilemma and adjustment from copyright system are also covered. Second, the international copyright treaties are analyzed for paving the way for the expansion of Copyright to be applied in the age of the Internet. Third, the paper then surveys the according amendment of E.U. copyright law with an in-depth analysis of directives of the European Parliament and those of the Council of copyright and related rights. A comparison between the amendment of E.U. copyright law and that of Taiwan done on July 2003 will also be made at the end of this thesis to locate some workable references. The adjustment and expansion of the Copyright law to be applied in digital environment must reach the balance point in the midst of digital technology, private interest and public advantage. Creators can get an appropriate remuneration for their works; the public can utilize the work legally and works themselves will circulate more freely. The spirit of Copyright system can again be manifested in the digital world.
