    Abstract:   本文首先說明隱私權之起源及其基本概念,再從此概念劃分出隱私權類型,推導出資訊隱私權、病歷隱私權之內涵,進而論述醫療資訊隱私權之意義。其次,介紹健保IC卡政策之基本內容,將健保IC卡之特性與功能加以說明,並簡述中央健保局欲實施此政策之目的與原意,再論及健保IC卡之安全防護機制。同時,將健保IC卡政策實施過程中,所產生之涉及醫療資訊隱私權之相關問題,做一探討;包括醫療院所為因應健保IC卡政策,所改變之病歷管理方式,如由過去有形的紙本病歷,將轉化成一部分的電子病歷,並將部分個人資料儲存在晶片IC卡中,做為就診記錄。而整個醫療院所的電子系統,對於病歷隱私的防護技術層次,都會納入此爭議部分,加以探討。而本文並參酌國內有關電子病歷防護的相關法規,從法律面的立法原意,與法律的規範技術面,來檢視該政策在實施後,對民眾之隱私權是否構成侵害,是否造成侵權行為,以及法律的救濟途徑為何。最後,參考國外立法案例,針對隱私權保護之立法趨勢,與現行IC卡政策做一比較,試圖從政策中找出不完善之處,進而提出修法方向與政策建議。
    First, the article explains the source of medical information privacy and its basic conception, and from the conception which is divided category of the privacy right , and to deduce the connotation of the information privacy and the anamnesis privacy ; further, discource the meaning of the medical information privacy. Second, introduce the fundamental contents of Healthy Insurance IC card policy and to interpret the characteristic and function of Healthy Insurance IC card, then give a brief introduction of the policy's purpose and original intention of Bureau of National Health Insurance, and discourse the security shelter system of Healthy Insurance IC card. Furthermore, discuss the issues of the Healthy Insurance IC card policy that had been to put into practice about the medical information privacy; including medical institution how to deal with the Healthy Insurance IC card policy that had been changed to manage the anamnesis--for example, visible paper anamnesis will transform into a part of electronic anamnesis, and storage some personal data into the electronic IC card that have been to regard as a diagnosis record. By the way, the article will discuss the issue for the security technology aspect of the anamnesis privacy that is about the whole electronic system of the medical institution. Besides, the article deliberated to some laws which is related to electronic anamnesis protection, from the legislation of original intention on law aspect and norm of technique area of law aspect that how to survey the policy which had been into practice, with regard to the policy, whether the people's privacy right which had been violated or turn into infringement act, and which is the method how to give relief to the action of law aspect. Finally, the article consulted cases of legislation abroad, and then in accordance with the tendency of the protection of the right of privacy, which compare with the IC card policy and try to find to faulty of the policy, then try to go a step further to bring up the amendments and suggestion of the policy.
