    摘要: 　　身心障礙鑑定的法源為殘障福利法、身心障礙者保護法及身心障礙者權益保障法，因此本文藉由分析「身心障礙者權益保障法」的演變來探討身心障礙鑑定的發展。殘障福利法自1980年立法開始到現今2015年的身心障礙者權益保障法，這35年來經過了17次的修法與2次的更名；而身心障礙鑑定隨著法源的修法也作了9次的修正。本研究將身心障礙者權益保障法與身心障礙鑑定的修法過程分成3個階段：殘障福利法、身心障礙者保護法及身心障礙者權益保障法，依照這3個階段順序來說明與比較其修法歷程與變革，並進一步的進行分析探究身心障礙者權益保障法與身心障礙鑑定頻繁修法的原因。
    　　The sources of disability evaluation are Welfare Law for Handicapped Persons, Physically and Mentally Disabled Citizens Protection Act, and People with Disabilities Rights Protection Act, therefore, the writer analyzes the development of disability evaluation through studying the changing of People with Disabilities Rights Protection Act. It’s been 35 years since Welfare Law for Handicapped Persons was enacted and promulgated in 1980. People with Disabilities Right Protection Act has been revised 17 times and its title has been amended 2 times. Disability evaluation has changed 9 times because of the revisions of its sources. This thesis divides People with Disabilities Rights Protection Act into three stages: Welfare Law for Handicapped Persons, Physically and Mentally Disabled Citizens Protection Act, and People with Disabilities Rights Protection Act. This study tries to not only explain the history of the People with Disabilities Rights Protection Act but also compare the changes in the disability evaluation. This thesis concludes by analyzing and investigate what caused People with Disabilities Rights Protection Act and disability evaluation has been amended frequently.
