    Abstract: 德國學者哈伯瑪斯(Jurgen Habermas)曾認為,歐洲統合在憲法愛國主義的薰陶下,已培育出一種新型的「後民族主義」(post-nationalism)。由於當前的歐洲治理乃係透過公民社會的平等合作,而非舊式垂直的治理模式,因此公民社會的運作便成為歐洲治理的重要因素之一。本文主要的目的,即是試圖釐清「後民族主義」所產生的「法律規範下的集體認同」將如何影響到公民社會的運作,進而形成當前的歐盟治理模式,使得原先寄存於民族國家的民族主義受到撫平或壓制。
    German scholar Jurgen Habermas believes that the European integration has been bred post-nationalism, a new type of nationalism arising from the constitutional patriotism. Due to the current European governance was operated through equal cooperation of civil society, rather than the old vertical model of governance, and therefore the operation of civil society has become an important factor in European governance. The main purpose of this article, that is trying to clarify how the "post-nationalism" arising from "legal norms under the collective identity" to affect the functioning of civil society and thus take shape the current the model of EU governance. And it can pacify and suppress the original nationalism arised from nation-states.
