    Abstract: 本文探討立法院審查中央政府預算時，決議預算執行時以「凍」代「刪」所引發的憲政爭議。基本上，預算審查是為了「落實」法定程序，也必須深入體察預算內容的「財政」實質意義和預算形成過程的「政治」權力關係。換句話說，預算籌編與審議，應歸屬於「政策」形成層次，而立法院對預算審議及執行的監督，必須受自身權限所規範。否則，立法權侵犯行政權所導致的直接結果，除了削弱政府整體的治理能力，危及國民生命財產的安全保障外，更可能造成憲政體制混亂，破壞既有的民主憲政秩序。
