    Abstract:   網際網路已是人類生活中不可或缺的工具之一,垃圾郵件的問題造成網際網路通訊的品質的下降及損害網路使用者之權益,世界各國已開始正視垃圾郵件的問題。   本研究針對美國與我國在電子郵件廣告寄送的法律管制問題上進行探討,以美國的相關規範來對照我國現行法令的不足之處。除了法律規範外,本研究亦將討論其他管制措施的可能性,並就我國尚未通過的「電子郵件廣告管理條例」提供建議以及改善的方向。本研究認為要對垃圾郵件廣告進行較有效的管理可以由:立法面、技術面、管理機制與社會面等四個層面著手。最後,本研究認為電子郵件的廣泛使用已是長期的趨勢。為了網路通訊的暢通及使用者的權益,有必要為垃圾郵件問題專門立法。
      The internet has already become a part of human life. The problem of Spam is undermining the efficiency of internet as well as damaging users’ right. Virtually, all nations on earth have noticed the problem of spam.   This study compares the U.S. laws regarding spam with that of Taiwan’s. Besides, this study also discusses other methods to regulate spam, and supports the enactment of “ Electronic Mail Advertising Regulation”. It’s suggested that spam may be regulated in fours ways, namely,:”law”、”technology”、”management institution” and “society”.
